Terms of Service

Welcome to Vythara! By using our app, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

By downloading, accessing, or using Vythara (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Vythara ("we," "us," or "our").

2. Description of Service

Vythara is a mental wellness application that provides:

  • AI-powered chat support for emotional well-being
  • Daily mood tracking and check-ins
  • Digital journaling tools
  • Breathing exercises and meditation guides
  • Wellness resources and educational content
  • Crisis resource information

Important: Vythara is NOT a substitute for professional medical advice, diagnosis, or treatment. It is not intended to be used in medical emergencies. Always seek the advice of qualified health providers with any questions regarding mental health conditions.

3. Eligibility

You must be at least 13 years old to use Vythara. If you are under 18, you confirm that you have obtained parental or guardian consent to use the App. By using Vythara, you represent and warrant that you meet these eligibility requirements.

4. User Account and Security

When creating an account with Vythara:

  • You agree to provide accurate and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access or security breach
  • You may not share your account with others or create multiple accounts

5. Acceptable Use

5.1 You Agree To:

  • Use the App for personal, non-commercial purposes only
  • Comply with all applicable laws and regulations
  • Provide accurate information when using the App
  • Respect the intellectual property rights of Vythara and others

5.2 You Agree NOT To:

  • Use the App for any unlawful or harmful purposes
  • Attempt to reverse engineer, decompile, or hack the App
  • Upload malicious code, viruses, or harmful content
  • Impersonate others or misrepresent your identity
  • Scrape, data mine, or extract data from the App without permission
  • Use the App to harass, abuse, or harm others
  • Interfere with or disrupt the App's functionality

6. AI Chat and Content

Our AI companion, Buddy, is designed to provide empathetic support and wellness guidance. However:

  • AI responses are generated automatically and may not always be accurate or appropriate
  • The AI is not a licensed therapist, counselor, or medical professional
  • Conversations are not monitored in real-time
  • We do not guarantee the accuracy, completeness, or usefulness of AI responses
  • You should not rely solely on AI guidance for important health decisions

7. User-Generated Content

Your journal entries, mood data, and chat messages remain your property. However, by using Vythara, you grant us:

  • The right to store and process your content to provide our services
  • Permission to use anonymized, aggregated data for improving the App
  • The right to use your feedback and suggestions without compensation

You are solely responsible for the content you create. We reserve the right to remove any content that violates these Terms.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Intellectual Property

All content, features, and functionality of the App, including but not limited to:

  • Text, graphics, logos, icons, and images
  • Software code and algorithms
  • Audio files and meditation content
  • Design elements and user interface

are owned by Vythara and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

10. Third-Party Services and Links

The App may contain links to third-party websites, services, or resources (such as crisis hotlines). We do not endorse and are not responsible for:

  • The availability, accuracy, or content of third-party services
  • Any products, services, or materials available through third-party sites
  • The privacy practices of external websites

11. Subscription and Payments

Vythara offers both free and premium features:

  • Free features are available to all users at no cost
  • Premium features may require a subscription or one-time purchase
  • Subscription fees are billed in advance on a recurring basis
  • Prices are subject to change with 30 days' notice
  • Refunds are handled according to the App Store's or Google Play's policies
  • You can cancel your subscription at any time through your account settings

12. Disclaimers and Limitation of Liability

12.1 No Medical Advice

Vythara does not provide medical advice, diagnosis, or treatment. The App is designed for general wellness support only. In case of medical emergency, contact emergency services immediately.

12.2 "As Is" Service

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12.3 Limitation of Liability

To the maximum extent permitted by law, Vythara shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the App
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of the App
  • Any bugs, viruses, or harmful code transmitted through the App
  • Any errors or omissions in content or AI responses

13. Indemnification

You agree to indemnify, defend, and hold harmless Vythara and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your use of the App or violation of these Terms.

14. Modifications to the Service

We reserve the right to:

  • Modify, suspend, or discontinue any part of the App at any time
  • Update features, content, or functionality
  • Impose limits on certain features or restrict access to parts of the App

We will provide reasonable notice of significant changes when possible.

15. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Violation of applicable laws
  • Fraudulent or illegal activity
  • At your request

Upon termination, your right to use the App will immediately cease. You may delete your account at any time through the app settings.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Vythara operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through:

  • Good faith negotiations first
  • Binding arbitration if negotiations fail
  • In the courts of appropriate jurisdiction as a last resort

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid one that most closely matches the intent of the original.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vythara regarding the use of the App and supersede any prior agreements.

19. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by:

  • Posting the new Terms in the App
  • Updating the "Last Updated" date
  • Sending an email notification (if applicable)

Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

By using Vythara, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
